Yoga Dance — Terms of Sale

Article 1 – Purpose

These Terms of Sale ("Terms") set out the terms on which the training services offered by KREASY CHALLENGES, a professional training organization registered under number 01973180097, are sold. They apply to all trainings marketed by the organization, whether financed personally, by an OPCO (French joint training funding body), by France Travail (French public employment service), or through the Compte Personnel de Formation (CPF, French personal training account).

Article 3 – Scope

Any enrolment implies unreserved acceptance of these Terms.

Article 4 – Information about the trainings

Each training is the subject of: a detailed syllabus; any prerequisites; the teaching methods; the assessment methods; the training objectives. The educational content may evolve during the period of access to the training to reflect regulatory, scientific, technical or pedagogical developments. Such updates do not have the effect of changing the training's educational objectives.

Article 5 – Enrolment terms

Enrolment becomes final: once the contract or agreement is signed; once funding has been confirmed; once payment has been made, where payment is the trainee's responsibility. For trainings financed through the CPF, enrolment is carried out in accordance with the General Terms of Use of Mon Compte Formation.

Article 6 – Price

Prices are quoted in euros, exclusive of tax (HT). VAT does not apply, in accordance with Article 293 B of the French General Tax Code (Code général des impôts). Prices include the services listed in the syllabus. Incidental costs (travel, accommodation, personal equipment, etc.) remain the trainee's responsibility unless stated otherwise.

Article 7 – Payment

Payment may be made by credit card, bank transfer, or through CPF, OPCO or France Travail funding. Payment schedules are set out in the contract. Any late payment may result in the suspension of access to the platform. The Client agrees to pay the amounts owed in accordance with the signed training contract and the legal provisions applicable to the funding method used. Where payment is made in several instalments by direct debit, any failure to pay, even partial, ends the payment facility granted to the Client. In the event of any payment incident (single payment or instalments), Kreasy Challenges reserves the right to: immediately recover the full amount still owed by all legal means available; suspend the training in progress; refuse any new order until all amounts owed to the organization have been paid in full; and refuse to enter into any new direct debit agreement with the Client. The Client remains solely responsible for the consequences of non-payment of amounts owed. N.B.: In accordance with Article 2254 of the French Civil Code (Code civil), concerning the contractual arrangement of limitation periods, a formal notice sent by registered letter with acknowledgement of receipt (LRAR) interrupts the limitation period for debt recovery action. Where payment is made by the OPCO on which the trainee depends, it is the trainee's responsibility to submit the funding request before the training begins. The funding agreement must be provided at the time of enrolment and on the quotation that the trainee returns duly completed, dated, stamped, signed and marked "Bon pour accord" ("approved") to Kreasy Challenges. Where the OPCO only partially covers the cost, the difference will be invoiced directly by Kreasy Challenges to the trainee. If the trainee's funding agreement does not reach Kreasy Challenges at least one business day before the training starts, Kreasy Challenges reserves the right to refuse the trainee's entry into the training. In exceptional circumstances, payment may be made in instalments. In all cases, such arrangements must be formalized before the training begins.

Article 8 – Withdrawal

In accordance with the French Labour Code (Code du travail) and the French Consumer Code (Code de la consommation), the trainee has: 10 days for a professional training contract governed by the Code du travail; or 14 days for a contract concluded at a distance, governed by the Code de la consommation. No amount is payable during this period.

Article 9 – Cancellation and postponement

By the trainee — the terms differ depending on the funding method. Personal funding: in the event of interruption, withdrawal, or partial termination at the Client's initiative, only the portion actually completed will be invoiced on a pro-rata basis, calculated as follows: number of hours completed × €30; for the portion of the programme not completed, a flat-rate compensation of 25% of the corresponding amount will be withheld to cover administrative and organizational costs incurred. Amounts owed as a result of the interruption cannot be applied against the obligation to contribute to continuing professional training, nor can they be the subject of a funding request to an OPCO. The trainee agrees to pay Kreasy Challenges directly any amounts remaining due. The trainee may terminate the contract in the event of duly recognized force majeure; in that case, only the services actually provided are payable, in proportion to their value as set out in the contract (Article L. 6353-7 of the Code du travail). CPF: the cancellation terms are those set out in the General Terms of Use of Mon Compte Formation. OPCO: the cancellation terms are those set out in the training agreement and by the funding body. By the organization: the organization reserves the right to postpone a session; to change the dates; or to replace a trainer with another trainer of equivalent qualification.

Article 10 – Distance learning

Trainings are accessible through a secure teaching platform. The trainee is responsible for their internet connection and computer equipment. In the event of a technical problem originating from the platform, the organization will do everything possible to restore access as quickly as possible. The trainee is also responsible for ensuring their computer equipment is compatible with the technical requirements communicated by the organization.

Article 11 – Access to the platform

Access is strictly personal. Sharing login credentials is prohibited. The teaching content remains the exclusive property of KREASY CHALLENGES. Any reproduction is prohibited. Any simultaneous use of login credentials across multiple accounts, or their disclosure to a third party, may result in suspension of access to the platform.

Article 12 – Intellectual property

All videos, PDF materials, assessments, teaching content and documents provided are protected under the French Intellectual Property Code (Code de la propriété intellectuelle). Any copying, distribution or commercial use is prohibited without written authorization. The videos, course materials, worksheets, assessments, digital content and all other elements making up the trainings remain the exclusive property of KREASY CHALLENGES. Any reproduction, distribution, recording, extraction, commercial use, or use in whole or in part, without prior written authorization is strictly prohibited.

Article 13 – Certification

Where a training leads to a professional certification registered with France Compétences (the French national certification authority), the assessment methods are set out in the assessment framework provided to the trainee. Certification is awarded subject to meeting the criteria set out in the applicable certification framework. In accordance with the provisions applicable where a training is financed, in whole or in part, by the Compte Personnel de Formation (CPF) and leads to a professional certification, the trainee is informed that they must attend the certification examinations scheduled at the end of their programme. Passing the certification is not a condition of funding: the trainee may sit the examination without obtaining the certification. However, in accordance with the provisions applicable to CPF funding, failure to attend the examination or certification tests without legitimate grounds may have consequences on the use of the trainee's CPF entitlement and, depending on the circumstances provided for by the regulations, may result in a request for repayment of the amounts covered. The trainee therefore agrees to: attend the training diligently; complete the full programme; attend the certification examinations to which they are summoned; inform the training organization as soon as possible of any difficulty that might prevent their attendance at the examination; and provide, where necessary, any supporting document justifying an absence or a request for postponement. The training organization monitors trainees' progress and keeps records to evidence the summons and attendance of the trainee at the certification examinations. This obligation concerns attendance at the certification, not obtaining it.

Article 14 – Data protection

Personal data is processed in accordance with the GDPR. The trainee has a right of access, rectification, objection and erasure. Requests may be sent to: administration@yogadanse.eu. Data is retained for the period necessary to comply with the legal, accounting, educational and regulatory obligations applicable to training organizations.

Article 15 – Complaints

Any complaint must be submitted in writing to: administration@yogadanse.eu. The organization undertakes to respond within a reasonable time.

Article 16 – Consumer mediation

In accordance with Articles L.611-1 et seq. of the Code de la consommation, any consumer may resort free of charge to a consumer mediator with a view to the amicable resolution of a dispute. Article 17 – Force majeure

Neither party may be held liable in the event of force majeure within the meaning of Article 1218 of the French Civil Code (Code civil).

Article 18 – Governing law

These Terms are governed by French law. In the event of a dispute, the parties will seek an amicable solution before taking any legal action. Failing that, the competent court will be the one with jurisdiction over KREASY CHALLENGES' registered office, subject to any mandatory legal provisions to the contrary.

Article 19 – Duration of platform access

The terms of access to the teaching platform are set out in the training contract or agreement. Unless stated otherwise, the trainee has personal access to the platform for the period specified at enrolment. The organization reserves the right to extend this access on an exceptional basis, without this constituting an acquired right for the trainee.

Article 20 – Assessments and certification

Where a training leads to a professional certification registered with France Compétences, the trainee is informed of the assessment methods before enrolling. Assessments may include, among other things: knowledge questionnaires; written work; professional simulation exercises; instructional videos; an interview with a panel. Certification is awarded only when all the criteria set out in the assessment framework are met. In the event of absence from a certification test, a postponement may be offered according to the terms defined by the training organization. Any attempt at fraud, plagiarism, or submission of work carried out by a third party may result in the cancellation of the assessment concerned, or even exclusion from the certification process. Assessment methods may evolve to remain consistent with the requirements of the certifying body or of France Compétences.

Article 21 – Use of artificial intelligence tools

The use of artificial intelligence tools (or any other writing or content-creation assistance system) is permitted only where it serves as an aid to thinking through or structuring the trainee's own personal work. The trainee remains solely responsible for the work submitted. Assessments must reflect the skills actually acquired by the trainee. The training organization reserves the right to request any evidence needed to verify the authenticity of the work submitted.

Article 22 – Recordings and image rights

Videoconference classes or certain teaching sequences may be recorded for teaching purposes. The trainee is informed that they are prohibited from recording, reproducing, distributing or sharing all or part of the training content without the written authorization of KREASY CHALLENGES. Any unauthorized recording or distribution may result in legal action.

Article 23 – Confidentiality

The parties agree to keep confidential any educational, commercial, financial or technical information they may become aware of in the course of the training. This obligation continues after the training has ended.

Article 24 – Acceptance of these Terms

Enrolling in a training implies full and unreserved acceptance of these Terms of Sale.
